Unless otherwise stated, this website and its content, including its text, design, layout, graphics, logos, images, documents, recordings and downloadable material, belongs to us or our licensors. Accounts and membership

If you have a Women in Automotive membership account that you access via our website, you are responsible for keeping your account credentials secure and for providing accurate account information. Becoming a member may be subject to separate terms and conditions (addressing items such as eligibility, inclusions, renewal timing, cancellation options and current pricing) that will either be shown at checkout or otherwise communicated to you. Women in Automotive may suspend or close an account where these Terms are materially breached or where this is reasonably necessary to protect the community or website.

Payments and events

For any purchases made via the website, payments are processed by the payment provider shown at checkout and may be subject to that provider’s own terms and privacy policy. Prices are in Australian dollars and any GST treatment is stated with the relevant offer. Event availability, changes, cancellation and refund arrangements are set out on the relevant event page (as applicable) and below.

Refunds

Subject to any rights you may have under the Australian Consumer Law, refunds are only available where required by law or where expressly stated in these Terms or in any other refund terms that apply to the relevant purchase, including any specific terms for events, memberships or the Jobs Board.

You may be entitled to a refund or other remedy if:

  • the services are not provided with due care and skill;

  • the services do not match the description given to you;

  • the services are not fit for a purpose or result that you made known to us, or for which services of that kind are commonly supplied; or

  • you are otherwise entitled to a refund or other remedy under the Australian Consumer Law.

You are not entitled to a refund of the unused portion of your membership if you choose to terminate your membership early, except where required by law or expressly stated in any membership terms that apply to you.

To request a refund, please contact us at hello@womeninautomotive.com.au within 72 hours after becoming aware of the issue and provide any information reasonably needed to assess your request. We will review the request and determine the appropriate remedy, including whether a refund is payable.

If a refund is payable, it will be issued to the original payment method used for the purchase, unless we agree otherwise. The amount of any refund may take into account the nature of the issue, the extent to which the relevant services have been provided or used, and any remedy required by law.

Nothing in these Terms excludes, restricts or modifies any guarantee, right or remedy that cannot be excluded, restricted or modified under the Australian Consumer Law.

This website may link to third-party websites, including employer websites and application systems. We are not responsible for their content, availability, security or privacy practices, and a link is not an endorsement.

Liability

To the extent permitted by law, Women in Automotive is not liable for loss arising from use of this website, a third-party service or a Jobs Board listing. Where liability cannot be excluded, it is limited to the remedy required by law.

Privacy and changes

Our Privacy Policy explains how we handle personal information. We may send service communications, membership updates, event information and marketing communications in accordance with our Privacy Policy and applicable consent settings.

We may update these Terms from time to time. Material changes will be posted on this website and, where appropriate, communicated to affected members.

Contact and governing law

Questions, complaints or concerns about these Terms and Conditions, website content, a Job Board advertisement or memberships can be sent to hello@womeninautomotive.com.au.

These Terms are governed by the laws of Victoria, Australia.

Part B – Jobs Board terms

Women in Automotive operates a “Jobs Board” on this website as a paid advertising service (Jobs Board).

You can apply for an advertisement placement on the Jobs Board by completing the Jobs Board form on this website and paying the applicable fee. Each such application entitles you to advertise one position, subject to our approval and these Terms and Conditions. By making such an application, you warrant and agree that you are authorised to do so on behalf of the advertising organization (and both you and the advertising organisation are jointly and severally responsible for the advertisement and for compliance with these Terms).

You acknowledge and agree that:

  • we decide which advertisements (and the relevant content) will appear on the Jobs Board and how it is presented;

  • advertisements will typically remain published online for a four week period (unless requested otherwise);

  • the Jobs Board is an advertising service only. Women in Automotive is not a recruitment agency, an employment agent or an employer, and is not a party to any dealing, agreement or employment relationship between an advertiser and a candidate; and

  • payment secures review for potential publication, and not an automatic right to publication. Every advertisement is reviewed by Women in Automotive before it appears. We do not guarantee a publication date or time, and an advertisement appears only once we have approved and published it. We do not guarantee any level of traffic, visibility, applications, candidate quality or recruitment outcome.

Fees

The fee to apply for an advertisement, the total amount payable including GST, and the period for which an approved advertisement will appear, are shown at the time of purchase. The fee that applies is the fee shown when the advertisement application is purchased. We may vary our fees, the listing period and the features of the Jobs Board at any time, and a variation does not affect an advertisement already purchased. The payment provider shown at checkout issues the tax invoice or receipt for the transaction. If approved, Women in Automotive may allow an advertisement to remain on the Jobs Board beyond the stated listing period at its discretion. Doing so on any occasion creates no entitlement to an extended period on any other occasion, and no fee is refunded, reduced or increased as a result.

Advertiser responsibilities

The advertiser is responsible for the content and accuracy of its advertisement and for its own recruitment process, including how it receives, handles, stores and discloses the personal information of applicants. The advertiser must only use applicant information for recruitment-related purposes and must handle that information in accordance with applicable privacy laws. The advertiser warrants that each advertisement it submits:

  • relates to a genuine employment opportunity that is available at the time of submission;
  • is accurate and not misleading or deceptive, including as to the identity of the employer, the nature of the role, its location, its employment type and its remuneration, and does not contain any content that is unlawful, misleading or deceptive, discriminatory, defamatory, offensive or inappropriate;
  • complies with all applicable laws, including the Australian Consumer Law, anti-discrimination law, workplace and industrial relations law, and privacy law;
  • does not require a candidate to pay a fee, purchase goods or services, or make any investment in order to apply for or be engaged in the position;
  • does not promote a multi-level marketing scheme, a franchise or business opportunity, a training course, or any offering that is not a genuine employment opportunity; and
  • does not infringe the intellectual property, moral, privacy or other rights of any person, and that the advertiser holds all rights and consents necessary for any name, logo, image, business name, trade mark or document included within the advertisement.

By submitting an advertisement, the advertiser grants us a non-exclusive, royalty-free, worldwide licence to use, reproduce, publish, display, adapt and communicate the advertisement and any material supplied with it for the purpose of operating, publishing and promoting the Jobs Board, including through this website, in Women in Automotive newsletters, social media and other channels, for any listing period determined by us and for a reasonable period afterwards to the extent necessary for record-keeping, archive, reporting and promotional purposes connected with the Jobs Board.

Candidates are responsible for assessing any advertised role, employer and application process before applying. Women in Automotive may review advertisements before publication, but does not independently verify every statement in an advertisement or guarantee that a role remains available.

Refusing, editing and removing advertisements

Women in Automotive may refuse to publish, may edit, and may remove or suspend where it considers this reasonably necessary or appropriate, any advertisement that in its opinion is unsuitable for this website. Grounds on which we may do so include, without limitation, an advertisement that:

  • breaches these Terms or any Jobs Board guidelines published on this website;
  • is inaccurate, misleading, incomplete, or does not relate to a genuine available position;
  • is unlawful, discriminatory, offensive, defamatory, or otherwise inappropriate;
  • is inconsistent with the purpose, values or reputation of Women in Automotive or of the community it serves;
  • is not relevant to the audience of this website;
  • contains branding, promotional content, or links that are not reasonably connected to the advertised position; or
  • is submitted by an advertiser that has previously breached these Terms.

The decision whether an advertisement is suitable for this website rests with Women in Automotive. If we refuse an advertisement before it has appeared on the Jobs Board, we will notify the advertiser and refund the fee paid for that advertisement in full, and that refund is the advertiser’s sole remedy in respect of the refusal to the extent permitted by law. If we remove or suspend an advertisement after it has appeared, no refund is payable, although we may at our discretion offer a replacement placement where the removal was not caused by a breach of these Terms by the advertiser.

We may make minor changes to an advertisement for formatting, length, spelling, grammar or consistency without notice. We will contact the advertiser before making any change that alters the substance of an advertisement.

Refunds, cancellation and withdrawal

Once an advertisement has appeared on the Jobs Board, the fee paid for it is not refundable. This applies whether or not the position is subsequently filled or withdrawn, whether or not the advertiser still requires the advertisement, and whether or not the advertisement produced the response the advertiser expected.

An advertiser may cancel an advertisement that has not yet appeared on the Jobs Board by writing to us at hello@womeninautomotive.com.au, and we will refund the fee paid for it in full.

A request to withdraw an advertisement that has appeared on the Jobs Board must be made in writing to hello@womeninautomotive.com.au by the person who placed it or by an authorised representative of the advertising organisation. We will action a valid request within a reasonable time. Withdrawal does not entitle the advertiser to a refund or a credit.

Nothing in this section excludes, restricts or modifies any guarantee, right or remedy that cannot be excluded, restricted or modified under the Australian Consumer Law.

Liability and indemnity for Jobs Board content

To the extent permitted by law, Women in Automotive is not liable for any loss or damage arising from an advertisement, from any dealing between an advertiser and a candidate, or from the refusal, editing, removal, suspension, non-publication, timing of publication or expiry of an advertisement. Where our liability cannot be excluded, it is limited, at our option, to republishing the advertisement or refunding the fee paid for it, to the extent permitted by law.

The advertiser indemnifies Women in Automotive against any claim, loss, damage, liability or cost arising from its advertisement, from a breach of these Terms, from its handling of applicant personal information, or from its recruitment process, except to the extent that it is caused by Women in Automotive’s own negligence.
